The Court held the judge did not misdirect the jury: by stressing intent to rape and that the accused took active steps beyond mere preparation (forcing victim onto bed, assaulting her, stating intent to 'try her', attempting to remove her trousers) the jury were adequately instructed under the common law and the conviction for attempted rape should be upheld.
