Transcripts of the applicants’ private examinations are not privileged on the facts and, applying the Court of Appeal precedent, disclosure of those transcripts is not inconsistent with section 221 and rule 62; the court exercises its discretion to permit the applicants to exchange their own transcripts and to provide them to specified advisers and selected Grande group defendants subject to a solicitor’s undertaking limiting use to the Grande Proceedings, while refusing wider disclosure to the 9th and other defendants at this stage.
