At the interlocutory stage the court found there is a serious issue to be tried on the validity of the 15th elections and that the Harris J order did not supersede or modify Article 47; on balance of convenience, having regard to expired tenure of defendants, majority support at the AGM, lack of formal challenge by other members and the undertakings offered by the nine elected members, the court granted interlocutory mandatory and prohibitory reliefs in favour of the plaintiff pending trial.
