The court set aside the Mareva injunction and the joinder and leave to serve out in so far as they related to the fourth and fifth defendants and paragraph 7 of the amended writ because the plaintiff failed to demonstrate any good arguable cause of action against those defendants or proper evidential basis for allegations of fraud or conspiracy; service out was therefore unjustified. Joinder of the second and third defendants on paragraph 8 was not set aside as the amended claim was not clearly frivolous on its face but no substantive case has yet been proved against them.
