The appellate court found the original sentence for Charge 1 was excessive given the applicant's lesser, operational role and the disparity with co-defendants' sentences; it reduced the Charge 1 sentence from 3 years 8 months to 3 years. The court held the Charge 3 offence was distinct and committed earlier, so it was inappropriate to treat it as part of the conspiracy; accordingly six months of the one-year sentence was ordered consecutive and six months concurrent, producing an aggregate sentence of three years six months.
