HKSAR v. CHAN WING TIM AND ANOTHER

    Citation
HKSAR v. CHAN WING TIM AND ANOTHER
    Court
    Court of Appeal
    Case number
    CACC41/2008

The Court held that the disparity between the applicants' sentences and the 4-year sentence given to Yu did not justify reducing the applicants' sentences because the prosecution had lawful reasons to prosecute Yu separately and the trial judge had expressly taken Yu's lighter sentence into account and granted the applicants a full one-third discount; the starting points (7 years for 2nd, 8 years for 3rd) were not manifestly excessive, therefore leave to appeal against sentence was refused for the 2nd defendant and granted for the 3rd defendant whose sentence was reduced to 4 years 8 months.
