Once employment was established for the claimant (employed as a cabin attendant in 1979), the court must apply the statutory test for sex discrimination and compare her treatment with men employed in the same cohort; the differing retirement ages imposed on female cabin attendants (compelled retirement at 45) versus male cabin attendants (retirement at 55) amounted to unlawful sex discrimination under the Ordinance, and Cathay could not rely on contractual arrangements stemming from the discriminatory policy to avoid scrutiny.
