On the balance of probabilities the totality of features — specified working hours, day-rate remuneration, provision of heavy tools by the first respondent, absence of independent business structure or employees, lack of financial risk borne by the claimant and the pattern of control and payment — established an employment relationship; therefore claimant was entitled to employees' compensation and the HK$30,000 transfer was part of compensation rather than a loan.
