The defendant, by correspondence and conduct, agreed to defer completion pending determination by Vendor and Purchaser Summons and therefore could not later insist that title had to be proved by the original completion date; on the evidence (payments, possession, lack of claim by Ms. Luk) there was no real probability of a resulting trust in her favour and the plaintiffs had shown good title, entitling the Court to grant the orders sought including completion within one month.
