The amended summons was dismissed. Even assuming non-compliance with section 20A(2), on the proper application of ss20A(5) and (6) the appointment of the IO's solicitors could at most be voidable and not void; therefore Ying Kong's grounds for striking out or staying the proceedings were bound to fail. Ying Kong failed on all parts of its amended summons and must pay the IO's costs; the costs order nisi is made absolute, to be taxed on the District Court scale with a certificate for counsel, and costs are to be in any event rather than payable forthwith.
