The Hong Kong bank owed an implied duty of confidentiality to its Hong Kong customers governed by Hong Kong law; the Tournier exceptions do not extend to permitting the bank to transfer documents located in Hong Kong to its head office abroad for the sole purpose of evading Hong Kong law and complying with a foreign court order; Hong Kong courts may enjoin such transfer and disclosure and, on the facts, the appeal to discharge the injunction was dismissed.
