The court upheld the master's exercise of discretion under rule 62(2): on a fresh balancing of the competing interests the public interest in allowing the Department of Justice to use the court transcript derivatively to assist CCB investigations into alleged fraudulent conduct outweighed the respondent's interest in absolute confidentiality; release was authorised subject to strict confidentiality and use restrictions and with an undertaking that the transcript not be used in the respondent's retrial or disclosed in other proceedings.
