Under OSCO the court's role at the s8 confiscation stage is limited to assessing the defendant's benefit and not to adjudicating third‑party ownership or beneficial interests; third parties therefore lack standing to intervene as parties at this stage and may pursue claims in enforcement under s17(8) or in civil proceedings.

The court exercised its discretion under s132 Cap 528 to decline outright forfeiture of all machines and, having considered statutory purpose, deterrence, hardship and the parties' proposals, ordered partial return of certain items and accepted a payment in lieu (HK$1.3m) with specified conditional forfeiture: items 9–16 returned; items 23–28 forfeited unless full payment of the fine; and HK$1.3m payable to Government by 1 February 2005.

The magistrate properly exercised his unfettered discretion: on the balance of probabilities the claimant failed to prove a genuine leasing arrangement, retained ownership responsibilities, was aware of cross‑border trade risks, and did not take steps to prevent illicit use; therefore forfeiture of the vehicle and keys was justified and the appeal is dismissed.

The Special Magistrate failed properly to consider the aggregate effect of 47 similar offences; although individual fines of HK$10,000 were not per se manifestly excessive, the total fine of HK$470,000 was manifestly excessive.
