The magistrate's confiscation order was supported by the appellant's admissions and the interview record which showed the money comprised welfare payments/savings and was used to purchase the drugs or represented proceeds; accordingly s.56(1) authorised confiscation and there was ample basis for the magistrate's order, which is therefore upheld.
