The Court of Appeal held the judge erred in law and misapplied the test for risk of dissipation by excluding the substantive allegations of serious, systemic dishonesty and concealment from the holistic assessment; taking the flight, evasive conduct, suspicious transactions and the scale/complexity of alleged fraudulent connected dealings together provided a solid basis to conclude there was a real risk of unjustified dissipation of assets and justified granting a Mareva (worldwide freezing) injunction.
