The magistrate was legally wrong to refuse to issue private summonses solely because there had been no police investigation and no consent of the Secretary for Justice; private prosecutions can proceed in appropriate cases without those prerequisites, and therefore the appeals are allowed and the matters must be remitted to the magistrates' court for rehearing.
