The purported settlement was unenforceable for want of consideration and because allowing it would permit contractual extinguishment or reduction of statutory entitlements contrary to s.70 of the Employment Ordinance; accordingly the employee was entitled to recover statutory entitlements in full (long service payment calculated per s.31V, wages in lieu of notice, annual leave pay and statutory holiday/rest day pay) less the $50,000 already paid.
