The court found that an arbitration between Linfield and PCL had commenced by clear notice dated 28 December 2001; the three arbitrations raised common questions of law and fact and overlapping relief so consolidation under section 6B(1) was justified; the court therefore granted consolidation and, because parties could not agree on an arbitrator, lawfully appointed an arbitrator under section 6B(2); discretionary factors (timing, privacy, costs, risk of inconsistent decisions) did not preclude consolidation in these circumstances.
