Bail was refused because the appeal did not have a realistic prospect of success given the cogent evidence (CCTV footage, D1's confession and the applicant's recorded admissions) and because the trial judge's adverse inference from the applicant's silence was reasonable and unassailable on the material before the court.

The court adjusted the global effect by ordering specified concurrency rather than altering individual offence sentences.

Individual sentences were appropriate and left undisturbed, but the concurrency/consecutive ordering was adjusted to yield an overall term of four years imprisonment.

Leave to appeal against conviction out of time was refused because the applicant failed to provide any satisfactory explanation for the gross delay despite having legal representation for an extended period, offered no arguable grounds for attacking an unequivocal guilty plea entered after legal advice, and the fresh/new evidence was found not credible.
