The court held that 'immediate supervision' under reg 38E cannot be satisfied by two scaffolders simultaneously supervising each other while both are engaged in erection work; and on a case stated appeal the appellate court may examine transcripts included in the stated case and may correct a magistrate's factual finding when that finding is perverse (i.e. an error of fact amounting to an error of law).
