The court held that prior non-prosecution does not give rise to a legitimate expectation or constitute abuse of process in criminal proceedings and that regulation 6(1) penalises the act of erection (not a continuing offence), therefore the conviction for permitting structures on the date charged could not stand and must be set aside.
