Majority held that 'delivers any message for transmission' in s.23 refers to a two-stage situation (giving a message to another person or officer for onward transmission) and does not properly describe speaking into a microphone that directly effects transmission; accordingly the appellants were not guilty of the class 3 offence and their convictions were quashed; because construction disposed of the appeals the court declined to decide constitutionality of s.23 as applied.
