Plaintiff proved the loan agreements and first mortgages, defendants defaulted, contractual interest at 29.04% is recoverable pre- and post-judgment, the defendants' repayment defences lacked evidence (notably the HK$1,500,000 cheque was dishonoured and other alleged payments were unproven), partition was impracticable given the physical nature of the flats, and therefore orders for payment, vacant possession and sale under the Partition Ordinance were appropriate together with costs awarded to plaintiff.
