Insurer paid sanctioned settlements into court for a claim arising from a stand-alone scaffolding task excluded by the Policy; under Clause 6 together with section 42(3) E.C. Ordinance and the contribution statute the employer is liable to repay the sums paid and insurer's legal costs; therefore judgment for the plaintiff for the sums claimed, interest and costs follows.
