Control for the purposes of HCO s.12B(4) requires the ability to direct the master and crew in relation to navigation and employment of the vessel; the evidence did not establish that Maruba SCA had that degree of control over the 10 other vessels and therefore the Court has no in rem jurisdiction as to bunkers supplied to those vessels; accordingly the relevant parts of the Statement of Claim are struck out.
