HKSAR v. HUEN HO CHUEN
- Citation
- HKSAR v. HUEN HO CHUEN
- Court
- Court of First Instance
- Case number
- HCMA733/2014
The convictions were unsafe because the prosecution's oral grant of immunity to an accomplice was irregular, was not properly recorded or disclosed and the magistrate failed to address that or the accomplices' clear motive to cooperate; given the unreliable accomplice evidence, the remaining evidence was insufficient to prove the essential elements of LEPO and CAPPP beyond reasonable doubt, so convictions and sentences on Charges 1 and 4 were quashed.
