The court preferred Sze's evidence over Hui's, found the oral Agreement was established and that Hui had executed the transfer documentation but withheld it in breach of the Agreement; Hui's non est factum/false pretence allegations and his counterclaim alleging theft of about HK$44.25 million were not established; accordingly the court ordered relief in terms of the amended statement of claim (paras (1)–(8)) in Sze's action, dismissed Hui's counterclaim and dismissed Hui's separate action; costs follow the event and are to be paid by Hui to Sze.
