A marriage contracted pursuant to s.38(2) of the Marriage Ordinance confers a new monogamous marital status that supersedes (and absorbs, so far as possible) the earlier customary marriage; consequently the Supreme Court had jurisdiction under the Matrimonial Causes Ordinance to dissolve that monogamous status and a decree dissolves the parties' marital status.
