Judge found defendants credible, accepted that the late Mr Yeung intended Unit 714 to be held for his seven children, accepted that the 1st and 2nd defendants contributed to the equitable mortgage and later mortgage payments, and held that equity and the common intention/constructive trust principles (and s.5(2) Cap.219 exception) operated to declare Unit 504 held by the plaintiff on trust for the seven siblings including the 1st and 2nd defendants; accordingly plaintiff was not sole beneficial owner and his claims failed.
