Although a party is not obliged to counterclaim, where two sets of proceedings between the same parties encompass the same issues and relief and one is significantly more advanced, the court exercising its inherent jurisdiction and guided by the underlying objectives may strike out the later proceedings as an abuse of process; Vendor Purchaser Summons under s12 Cap 219 can deal with misrepresentation and rescission, and HCMP 6/2016 should be converted to a writ so it alone proceeds.
