Given the bankrupt's deliberate non‑cooperation—failure to attend or make himself available despite multiple express requests and solicitors' inability to confirm transmission of those requests or the client's whereabouts—the court exercised its discretion and made the normal non‑commencement order.

The court found the bankrupt failed to cooperate and his post-bankruptcy conduct was unsatisfactory by failing to provide income proof, annual statements and by not notifying trustees of his departure; although the bankrupt later provided information and no contribution was ultimately due, the failures justified an exercise of discretion to suspend the automatic discharge for a limited period; accordingly the relevant period was ordered to cease running for 6 months from 17 January 2009.

The trustees failed to prove the statutory grounds under s30A(4) on the evidence: the court preferred the bankrupt's direct evidence and inferred the trustees had misplaced originals and lost records; accordingly the objection was dismissed and the interim suspension was lifted with retrospective effect.
