In the exceptional circumstances of an arguable case of beneficiary fraud and in the absence of a bank undertaking to preserve the status quo, the court may grant an interim injunction restraining a bank from paying under a letter of credit pending a substantive hearing; the plaintiff nevertheless bears the burden of proving notice of fraud to the bank.
