Where particulars allege solicitation or acceptance to abstain from performing a specified public duty, the Crown must prove that the solicitation/acceptance was so framed, but it need not prove that the act or omission subsequently occurred; the offence is complete on solicitation/acceptance. Applying that rule, the recorded evidence and witness testimony proved the solicitation and acceptance as particularised; accordingly convictions stand though the trial judge misdirected on procedural questions, and the proviso applies.
