Clause 4 of the Joint Sale Agreement and the related irrevocable power of attorney are limited to express powers concerning the tender and sale and to act in default; those provisions did not confer on the six plaintiffs locus to demand title deeds of other Owners, therefore only the 5th plaintiff had a cause of action at the time of writ and is entitled to costs of the action and summons on party-and-party basis; indemnity costs not justified; the other plaintiffs must pay the defendant's costs; hearing costs to defendant to be borne by all plaintiffs.
