Because comprehensive documentary evidence (wage records, salaries tax return, bank statements, incorporation and leasing contracts) established that the 2nd Respondent paid the deceased's wages and the 1st Respondent was inactive, the 2nd Respondent was the employer; the death arose out of employment as the deceased was performing duties (buying spare parts for the vessel); therefore judgment for liability was entered against the 2nd Respondent and compensation awarded to the applicant under the Employees Compensation Ordinance.
