The High Court held that the value of the subject matter of the Share Sale Agreement exceeded $1,000,000 (defendant's own evidence indicated circa $25,476,750), therefore the District Court lacked jurisdiction under s52(1)(d); plaintiffs were justified in commencing and continuing in the High Court, obtained substantially all injunctive relief sought, and no basis existed to reduce costs under Lai Ki or Re Elgindata principles — accordingly defendant must pay plaintiffs' costs on a party and party basis on the High Court scale with a certificate for two counsel.
