The Court of Appeal upheld the High Court's exercise of discretion to refuse leave and to order costs against the applicants because (1) the leave applications were overtaken or rendered academic by developments in the CAT claims and lacked merit, (2) the court properly invited the putative respondent to file evidence and attend for case management purposes, and (3) the attendance materially assisted and resulted in an effectively substantive disposal at the leave stage justifying costs against the applicants; there was no basis to interfere with the judge's discretion.
