The court held that the respondent, having filed and then withdrawn the leave to appeal application, must pay the appellant's costs of that application; the appellant's unrepresented status does not bar an award of costs but is relevant to assessment; costs were assessed summarily at HK$2,000.

Leave to withdraw the summons was granted but withdrawal alone is not a sufficient reason to deny costs; the Plaintiff should have assessed the advisability of the application before prosecution and the Defendant incurred compensable costs. Accordingly the Plaintiff must pay the Defendant's costs for the earlier summons and related wasted costs up to the specified date and the costs of the subsequent withdrawal summons, to be assessed by the Registrar if not agreed.

The court awarded costs to the intended defendant for the aborted ex parte application because the plaintiff withdrew the application before the court decided, and accordingly the opposing party was entitled to costs; those costs are to be taxed in the HCMP proceedings (No. 2827/1994).
