Applying the Rules and summary assessment principles the court allowed recovery of costs to the defendant for identified folios, applied pre-2018 hourly rates, made specific awards for Sections E, F and G and acting in person work, and ordered the plaintiff to pay HK$502,000 with interest from 14 April 2016.

The judge exercised his discretion judicially and on correct principle: he declined to treat the dismissal as an exercise under Order 14 r.7, found no misuse of Order 14, ordered the costs of the Order 14 application before the Master to be costs in the cause, refused to vary the costs order as to the appeal or to grant a certificate for two counsel, refused indemnity costs and refused leave to appeal because there was no reasonable prospect of success; the defendant must pay the plaintiff's costs of the leave application.

The court refused to vary the costs order nisi and made it absolute; ratification cured any initial lack of authority so Linklaters is not personally liable for pre-ratification costs; YDL's directors are not personally liable as they were not the true beneficiaries of the action; the mandatory injunction and action stand and Ricky Liu must bear costs of YDL's representation and his application to vary, with specified apportionments and directions for filing fresh costs statements.
