Because the plaintiffs have a reasonably arguable case, the estate is of significant value, and their personal interest is contingent and potentially adverse to other beneficiaries, the court granted a limited Beddoe indemnity: plaintiffs to be indemnified out of the estate for 50% of their own costs and 50% of their liability for defendants' costs up to HK$392,388 each, assessed on a trustee basis, up to and including trial; costs of the present application to be paid out of the estate.
