The court refused to vary the costs order nisi because, given the timing of the offer (made on Day 1 while the Plaintiff was giving evidence) and the personal, non-commercial nature of the dispute, it was not reasonable to expect acceptance at that stage; in the exercise of its discretion the judge held the offer did not justify awarding costs from Day 2 onwards and confirmed no order as to costs, while declining to order costs for the application itself.
