The application for leave to appeal was dismissed because the trial judge, having warned himself about the dangers of identification evidence, was entitled to accept PW1's identification; counsel's conscious decision not to call the proposed ophthalmic expert was a rational tactical choice and not flagrantly incompetent, so fresh evidence under section 83V was properly refused and there was no basis to overturn the conviction.
