Even though the sergeant's evidence about the pager was hearsay and inadmissible, the voluntary cautioned statements by the applicant, together with the temporal and contextual coincidence of a man (Tang Hing-wong) with a pager being caught stealing a Lexus the same night and the content of the confession, provided sufficient evidence under the Bainbridge principle to establish counselling and procuring beyond reasonable doubt; thus the conviction was safe and must be dismissed on appeal.
