Because there was neither an application to the High Court nor a report under s.38, s.38(4) operated to vest the District Court with jurisdiction; the learned judge therefore erred in setting aside his oral judgment and ordering transfer, and the Court of Appeal restored the original judgment and remitted the matter to the District Judge to enter it and continue proceedings.
