- Case number
- CACC212/2017
Leave to appeal was granted because there existed a credible and material conflict of accounts between the applicant and her former advisers about whether mitigation evidence (participation in the anti-drug campaign and a letter from Father Wotherspoon) was known and deliberately not put before the sentencing judge; that conflict, if resolved in the applicant's favor, made it reasonably arguable that she did not receive a fair sentencing process and justified appellate investigation and resolution of credibility by the Full Court.
