The court held that while it cannot amalgamate distinct titles into a single property, where multiple separate properties are to be sold it may direct their sale together as if they constituted a single property if that is in the legitimate interests of co-owners and workable in practice; applying that test the court ordered all four adjoining lots be sold together and proceeds distributed according to undivided shares.
