An application under s.77E for letters of request is an ex parte originating application with no parties; consequently the suspected person is not a party entitled under O.63 r.4(2) to inspect documents filed in that cause; the Master erred in granting broad leave under O.63 r.4(1)(c) to inspect all documents related to such ex parte applications and that order must be set aside, subject to the limited right of any person to inspect the originating process under O.63 r.4(1)(a) (and to inspect court-made orders under O.63 r.4(1)(b) only if made in open court).
