The Court of Appeal allowed the appeal and held that an assignment between sub‑tenants does not as a matter of law necessarily create a new sub‑tenancy constituting a breach by the head tenant of a covenant against assignment or subletting; because there was an arguable defence the summary judgment was inappropriate and was set aside.
