Hong Kong law (lex fori) governs the claim to privilege; legal advice privilege in Hong Kong is confined to advice from qualified lawyers and will not be judicially extended to accountants; the two challenged documents did not contain legal advice from a lawyer (the solicitor was a conduit) and therefore were not privileged; accordingly the appeal is dismissed and respondents entitled to inspect the documents (fraud exception need not be applied).
