The prosecution established on the balance of probabilities a prima facie case that the mobile phone and SIM cards were used to communicate and transmit material connected to the trafficking and that the cash was possessed for the purpose of the trafficking trip; the defendant failed to satisfactorily rebut that case (including rejecting his interpreter-mistranslation claim and inconsistent statements); accordingly Exhibits P37-P40 fall within s.56(1) DDO and forfeiture is warranted.
